TERMS OF USE, WARRANTY & LIABILITY WAIVER

Terms of Use

This product, branded as the trademark Stumpy, is made available to you on your acknowledgement that there are and will be no modifications of the terms, conditions and notices set out herein. You may not modify, copy or reproduce this product. You acknowledge that Stumpy Manufacturing owns all intellectual property rights associated with the product Stumpy, worldwide and that no license in such intellectual property rights express or implied is acquired by you, by reason of your purchase of the product Stumpy. Stumpy Manufacturing reserves the right to change the terms, conditions and notices under which its products are offered at any time.

Use Limitation

Stumpy is designed for the chopping, cutting or splitting of wooden logs on its top surface, and for internal storage, and for seating only. This product is not intended to be used for any other purpose.

One Year Limited Warranty

Stumpy is warranted against any defective material or workmanship for a period of twelve months from date of shipment. Any product determined by Stumpy Manufacturing to be defective will be replaced in whole or part as determined by it, but no labor costs or other claims for loss or damages will be accepted. Products shall not be returned to Stumpy Manufacturing without prior written authorization.

Limitation of Liability

In no event shall Stumpy Manufacturing be liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever arising from the use or misuse of Stumpy or any other of its products. You acknowledge in particular that the chopping, cutting or splitting of wood with an axe or any other tool is inherently dangerous and carries the risk of severe personal injury or even death and that before you use Stumpy you must educate yourself as to the proper techniques for chopping, cutting and splitting wood.

Other Statements

Stumpy Manufacturing employees or representatives are not authorized to make any oral or written statements other than as specifically set out herein and if any such statements are made they do not constitute warranties with respect to Stumpy, shall not be relied upon by you, and are not part of the contract for sale nor the above-mentioned limited warranty with respect to any product of Stumpy Manufacturing.

Entire Obligation

The TERMS OF USE, WARRANTY AND DISCLAIMER in this document states the entire obligation of Stumpy Manufacturing with respect to the product Stumpy. If any part of this disclaimer is determined to be void, invalid, unenforceable or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effect.

General

This disclaimer statement is governed by the laws of the Province of Alberta, Canada. You hereby consent to the exclusive jurisdiction and venue of the Courts in that Province in all disputes arising out of or relating to the use of Stumpy.
